California Privacy Notice

Effective Date: July 22, 2026

This California Privacy Notice supplements the Open Choice Privacy Policy and applies solely to residents of the State of California. It is provided pursuant to the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).


1. Categories of Personal Information Collected

In the preceding 12 months, we may have collected the following categories of personal information:

A. Identifiers

  • Name, email address, phone number, mailing address, IP address, online identifiers, account identifiers, and payment-method metadata.

B. Commercial Information

  • Records of services requested, lead submission details, transaction history, funding history, lead delivery records, recharge records, refund records, and Buyer account activity.

C. Internet or Network Activity

  • Pages visited, interaction data, device and browser information, session activity, security logs, notification activity, and export activity.

D. Geolocation Data

  • Approximate location derived from IP address and location information provided in lead forms or business profiles.

E. Professional or Business Information

  • Business name, licensing details, DOT number, company information, truck count, operating state, service area, lead profile settings, routing preferences, and contact information.

F. Inferences

  • Lead eligibility scoring, marketplace routing logic, fraud risk signals, Buyer participation signals, and account eligibility signals.

G. Sensitive Personal Information

We do not knowingly collect sensitive personal information such as Social Security numbers, precise geolocation, biometric data, or health records for ordinary lead marketplace operations. Payment card information is processed by third-party payment processors; Open Choice does not store full card numbers.


2. Sources of Personal Information

We collect personal information directly from consumers and Buyers, automatically through website and Platform interactions, from service providers assisting with platform operations, fraud prevention, communications, payment processing, analytics, security, hosting, and data storage, and from public-record, DOT, business, or other third-party sources used to operate the lead marketplace.


3. Purposes for Collection and Use

We collect and process personal information to operate the lead marketplace, route submitted requests to eligible Buyers, deliver leads, manage Buyer funding accounts, process wallet funding and automatic recharges, provide Lead Portal and CRM tools, send notifications and verification codes, verify consent, detect fraud and abuse, maintain system integrity, resolve disputes, administer refunds, enforce agreements, and comply with legal obligations.

We do not use personal information for materially different purposes without providing notice as required by applicable law.


4. Sale or Sharing of Personal Information

Open Choice operates a marketplace that transfers consumer-submitted lead information to participating Buyers for the purpose of service fulfillment. Under California law, this transfer may be considered a "sale" or "sharing" of personal information. In the preceding 12 months, we may have sold or shared Identifiers, Commercial Information, Internet or Network Activity, Geolocation Data, Professional or Business Information, and Inferences.

We do not sell personal information in exchange for monetary payment outside the context of operating our lead marketplace. We do not knowingly sell or share personal information of consumers under 16 years of age.


5. Disclosure for Business Purposes

In the preceding 12 months, we may have disclosed the categories of personal information listed above to service providers that support hosting, security, fraud prevention, payment processing, communications, analytics, session replay, customer support, data storage, database operations, consent verification, lead delivery, and other platform operations.


6. Your California Privacy Rights

California residents have the right to:

A. Know

Request disclosure of categories of personal information collected, specific pieces of personal information, categories of sources, purposes for collection, and categories of recipients.

B. Delete

Request deletion of personal information, subject to legal exceptions.

C. Correct

Request correction of inaccurate personal information.

D. Opt Out of Sale or Sharing

Request that we not sell or share personal information, where applicable.

E. Limit Use of Sensitive Personal Information

We do not use sensitive personal information beyond purposes permitted by applicable law for ordinary lead marketplace operations.

F. Non-Discrimination

We will not discriminate against you for exercising your privacy rights.


7. Exercising Your Rights

You may submit a verifiable consumer request by email at privacy@theopenchoice.com or by phone at 855-938-6215. We may require identity verification before fulfilling requests. You may designate an authorized agent to make requests on your behalf where permitted by law and subject to verification.

Where legally required and technically feasible, we will recognize opt-out preference signals, including Global Privacy Control or similar browser-based signals, as a request to opt out of sale or sharing for the browser or device sending the signal. Because our marketplace may rely on contact information submitted through forms to fulfill a consumer's own request, certain service-related disclosures may still occur as permitted by law.


8. Retention

We retain personal information for as long as reasonably necessary to operate the marketplace, maintain business records, process billing and refunds, preserve consent and delivery records, prevent fraud, resolve disputes, comply with legal obligations, and enforce agreements. Retention periods vary based on data type, legal requirements, operational needs, and dispute history.


9. Automated Decision-Making

Our Platform uses automated systems to score leads, apply routing logic, detect duplicates, trigger availability notifications, evaluate Buyer eligibility, reserve charges, and operate marketplace allocation. These systems do not produce legal or similarly significant effects regarding consumers beyond marketplace matching.
